I think the CPUs are cheating beacause everytime I'm in front of one, they speed up utill they are in front of me, I call that bondage racing, and I hate the CPUs doing that

No it's something they put in for the CPUs only. Rubberbanding is to make keeping the top spot more challenging, try to make the race a lot more interesting by making 1st harder to maintain (although the blue shell does more than a good job at this)

If the CPU's are difficult mode they always go faster than you, but they can't drift so you can still easily overtake them.

If a CPU was to cheat they may have AI. They are only programmed to go a certain speed for whatever difficulty is selected.
