This is a fangame, Wargor aren't isn't selling anything, and it doesn't compete with mainline games. I don't think Nintendo has a legit reason to take down this site.

they're probably not gonna take it down, this website is like completely different from the official mario kart games. Although it is pretty popular; i told my friend from my local theater about it and he said "oh yeah i've heard of it, never played it myself though"
